Welcome to FRTIL (“FRTIL,” “we,” “us,” “our”). We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). The Services are powered by Shopify.

These Terms of Service (“Terms”) together with the documents they reference (including our Privacy Policy, Refund & Return Policy, and Shipping Policy) describe your rights and responsibilities when using the Services. By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

You represent you are at least the age of majority in your state or province of residence and you authorize any minor dependents using devices you own to use the Services. You agree to provide accurate, current, and complete information and to maintain the security of your account credentials. You are responsible for all activity under your account and may not transfer or license your account to any other person.

2. OUR PRODUCTS

We strive to display products accurately; however, colors and appearance may vary by device. Descriptions, pricing, and availability are subject to change without notice. We may discontinue products or limit quantities at any time.

3. ORDERS

Your order is an offer to buy. We may accept or decline any order at our discretion; acceptance occurs when we confirm it and process payment. Please check orders carefully—cancellations may not be possible after acceptance. If we cancel or change an order, we’ll attempt to notify you using the contact details provided. Purchases are for personal/household use only and not for resale or export. Returns are handled per our Refund & Return Policy.

4. PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the one in effect at checkout and in your confirmation email, excluding taxes, shipping, handling, customs, and import fees unless stated otherwise. You agree to provide current, complete billing information and authorize charges to your payment method. If you paid for shipping at checkout, those charges are non-refundable; “free shipping” costs may be deducted from refunds as described in our Refund & Return Policy.

5. SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss transfer to you upon delivery to the carrier. See our Shipping Policy for details.

All content and materials on the Services (text, graphics, logos, images, video, audio, design, and arrangement) are owned by FRTIL or its licensors and are protected by applicable laws. Use is permitted only for personal, non-commercial purposes. No licenses are granted except as expressly provided. FRTIL names, logos, and marks are our trademarks; other marks belong to their owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Use is at your own risk and subject to the third party’s terms.

8. THIRD-PARTY LINKS

Links to third-party sites or embedded functionality are provided for convenience. We are not responsible for their content, policies, or transactions. Review the third party’s terms and privacy policies before engaging.

9. RELATIONSHIP WITH SHOPIFY

FRTIL is powered by Shopify. Your purchases are with FRTIL, not Shopify. You agree Shopify is not responsible for sales between you and FRTIL and you release Shopify and its affiliates from claims arising from your transactions with FRTIL.

10. PRIVACY

Personal information collected through the Services is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information to provide and improve the Services; see the Shopify Privacy Policy.

11. FEEDBACK & USER CONTENT

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display the Feedback in any medium for any lawful purpose. You warrant you have all rights necessary, that your Feedback complies with law, and that it contains no malware or deceptive statements. We may remove content at our discretion.

12. ERRORS, INACCURACIES, AND OMISSIONS

Occasionally information on the Services may contain errors or omissions (e.g., product descriptions, pricing, offers, shipping charges, transit times, availability). We may correct or update information and cancel orders if information is inaccurate, at any time and without prior notice.

You may use the Services only for lawful purposes. Prohibited conduct includes, without limitation: violating laws or rights of others; harassing or harming others; transmitting malware; unauthorized advertising or scraping; impersonation; interfering with security features; or any activity that, in our judgment, harms FRTIL, Shopify, or users. We may terminate or suspend access to the Services at any time without notice. Sections that by their nature should survive (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive termination.

EXCEPT AS EXPRESSLY STATED BY FRTIL, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW DISCLAIMERS; SOME RIGHTS MAY APPLY.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRTIL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/DATA, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR $100, WHICHEVER IS GREATER. SOME JURISDICTIONS LIMIT SUCH EXCLUSIONS; SOME RIGHTS MAY APPLY.

17. INDEMNIFICATION

You agree to indemnify and hold harmless FRTIL, Shopify, and their affiliates, officers, employees, and agents from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your breach of these Terms, or your violation of law or rights of others. We may control the defense and settlement of any claim; you will cooperate with us.

18. SEVERABILITY

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will remain in effect.

19. WAIVER; ENTIRE AGREEMENT

Failure to enforce any right is not a waiver. These Terms, together with policies posted on the site, are the entire agreement between you and FRTIL regarding the Services and supersede prior agreements.

20. ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

21. GOVERNING LAW; VENUE

These Terms and any related dispute are governed by the laws of the State of California, without regard to conflict-of-laws rules. You and FRTIL consent to exclusive jurisdiction and venue in the state and federal courts located in Los Angeles County, California.

22. HEADINGS

Headings are for convenience only and do not affect interpretation.

23. CHANGES TO TERMS

We may update these Terms from time to time by posting a new version on the site and updating the “Last updated” date. Material changes will be notified as required by law. Continued use of the Services after changes means you accept the revised Terms.
